This website is operated by Truly Healthy Inc., operating as Truly Market (“Truly Market”, “we”, “us” or “our”). We offer this website, including all information, tools and services available from it (the “Service”), to you on the condition that you accept these terms, conditions, policies and notices.
By visiting our site or buying from us, you agree to these Terms of Service (“Terms”), including the additional policies referenced here and linked from this page, such as our Refund Policy, Shipping Policy and Privacy Policy. These Terms apply to all users of the site, including browsers, customers and people who contribute content.
Please read these Terms carefully. If you do not agree to them, please do not use the website or the Service. Any new features or tools added to the store are also subject to these Terms.
Nothing in these Terms limits any rights you have under Ontario consumer protection legislation or any other consumer protection law that applies to you and cannot be waived or excluded by contract.
Section 1 – Online store terms
By agreeing to these Terms, you confirm that you are at least the age of majority in your province, territory or other place of residence, or that you are the age of majority and have given your consent for your minor dependants to use this site.
You may not use our products for any illegal or unauthorized purpose, and you may not, in using the Service, violate any laws in your jurisdiction (including copyright laws). You must not transmit any worms, viruses or other destructive code. If you breach these Terms, we may end your access to the Service immediately.
Section 2 – General conditions
We reserve the right to refuse service to anyone for any lawful reason at any time.
You understand that your content (not including credit card information) may be transferred unencrypted and may involve (a) transmission over various networks and (b) changes to conform to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the Service, access to the Service, or any content on the website through which the Service is provided, without our express written permission.
Headings in these Terms are for convenience only and do not limit or affect them.
Section 3 – Accuracy of information on this site
We work to keep information on this site accurate, complete and current, but we cannot guarantee it. The material on this site is for general information only and should not be relied on as the sole basis for decisions. This site may contain historical information that is not current. We may change the contents of this site at any time, but we have no obligation to update it.
Section 4 – Health information
Product descriptions and other content on this site, including anything shared by our team, are for general information only and are not medical advice. Natural health products we sell are authorized for sale in Canada (look for the NPN or DIN on the label) and should be used only as directed on the label. Any health claim for a product is limited to what appears on its Health Canada–authorized label. Talk to your doctor, pharmacist or another qualified healthcare practitioner before starting any supplement, especially if you are pregnant or nursing, are taking medication, or have a medical condition. Do not exceed the recommended dose.
Section 5 – Changes to the Service and prices
Prices are shown in Canadian dollars (CAD) and do not include applicable taxes, which are calculated at checkout. Prices may change without notice, but a change will not affect an order we have already accepted. We may modify or discontinue the Service (or any part of it) at any time without notice, and we are not liable to you or any third party for doing so.
Section 6 – Products
Some products may be available only online and may be limited in quantity. Returns and exchanges are handled under our Refund Policy.
We make every effort to display product colours, images and packaging accurately, but your screen may not show colours exactly, and manufacturers may change packaging without notice.
We may limit sales of any product to any person, geographic region or jurisdiction, on a case-by-case basis. Refrigerated items are available for GTA delivery or in-store pickup only. We may limit quantities, change product descriptions or pricing, or discontinue any product at any time. Any offer made on this site is void where prohibited.
Section 7 – Orders, billing and account information
We may refuse or cancel any order. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order, including orders placed under the same customer account, payment card, or billing or shipping address. If we change or cancel an order, we will try to notify you using the email, billing address or phone number provided with the order, and we will refund any amount charged for the cancelled portion. We may limit or refuse orders that appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information, and to promptly update your account details, including your email address and payment information, so we can complete your transactions and contact you as needed.
Section 8 – Optional tools
We may give you access to third-party tools that we do not monitor or control. These tools are provided “as is” and “as available”, without warranties, representations or conditions of any kind and without endorsement. Your use of them is at your own risk, and you should review the terms on which the relevant third party provides them. New features or services we add to the website are also subject to these Terms.
Section 9 – Third-party links
Some content, products and services available through the Service may include materials from third parties, and links on this site may take you to third-party websites not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we are not liable for any third-party materials, websites, products or services, or for any transactions you make with third parties. Please review their policies and practices before you engage with them, and direct any questions about third-party products to that third party.
Section 10 – Reviews, comments and other submissions
If you send us product reviews, creative ideas, suggestions or other materials, whether online, by email, by post or otherwise (“comments”), you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium without restriction. We have no obligation to keep comments confidential, to pay compensation for them, or to respond to them.
We may, but are not required to, monitor, edit or remove content that we determine in our sole discretion is unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone’s intellectual property or these Terms.
You agree that your comments will not violate the rights of any third party, including copyright, trademark, privacy or personality rights; will not contain defamatory, unlawful, abusive or obscene material; and will not contain any virus or other malware. You may not use a false email address, pretend to be someone else, or otherwise mislead us or others about the origin of any comments. You are solely responsible for your comments and their accuracy.
Section 11 – Personal information
Your submission of personal information through the store is governed by our Privacy Policy.
Section 12 – Errors, inaccuracies and omissions
Occasionally, information on our site may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change information or cancel orders if information is inaccurate, at any time without prior notice, including after you have submitted your order. If we cancel your order, we will refund any amount you paid for it.
Section 13 – Prohibited uses
In addition to other prohibitions in these Terms, you may not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in unlawful acts; (c) to violate any international, federal, provincial or local laws or regulations; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service, any related website, other websites or the internet. We may end your use of the Service for violating any of these prohibited uses.
Section 14 – Disclaimer of warranties; limitation of liability
We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error-free, or that results obtained from the Service will be accurate or reliable. We may remove the Service for indefinite periods or cancel it at any time without notice.
To the maximum extent permitted by applicable law, the website and its content are provided “as is” and “as available”. Products you buy from us come with the warranties and conditions that consumer protection law provides, and nothing in these Terms excludes or limits them.
To the maximum extent permitted by applicable law, Truly Market and our directors, officers, employees, agents, contractors, suppliers and service providers are not liable for any indirect, incidental, punitive, special or consequential damages, including lost profits, lost revenue, lost savings or loss of data, arising from your use of the website. This does not limit our liability for personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Nothing in these Terms limits your rights as a consumer under applicable consumer protection law.
Section 15 – Indemnification
You agree to indemnify, defend and hold harmless Truly Market and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
Section 16 – Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will still be enforced to the fullest extent permitted by applicable law, and the unenforceable portion will be treated as severed from these Terms. This will not affect the validity and enforceability of the remaining provisions.
Section 17 – Termination
Obligations and liabilities incurred before termination survive the termination of this agreement. These Terms remain in effect until terminated by you or us. You may terminate them at any time by telling us you no longer wish to use our Service, or by ceasing to use our site. If, in our sole judgment, you fail, or we suspect you have failed, to comply with these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Service or any part of it.
Section 18 – Entire agreement
Our failure to exercise or enforce any right or provision of these Terms does not waive that right or provision. These Terms and any policies or operating rules we post on this site or in respect of the Service form the entire agreement between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written (including prior versions of these Terms).
Section 19 – Governing law
These Terms, and any separate agreements under which we provide you services, are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you are a consumer, this does not take away any protection you have under the consumer protection laws of the province, territory or country where you live.

We may update, change or replace any part of these Terms by posting changes to our website, and we will update the “Last updated” date above. Your continued use of our website or the Service after changes are posted means you accept those changes. Changes will not apply to orders placed before they were posted.
