Last updated: October 9, 2026

This Privacy Policy explains how Truly Healthy Inc., operating as Truly Market (“Truly Market”, “we”, “us” or “our”), collects, uses and discloses your personal information when you visit or shop at trulymarket.ca (the “Site”), shop at our store at First Markham Place, or otherwise communicate with us (together, the “Services”). “You” and “your” means you as a user of the Services, whether you are a customer, a website visitor or another individual whose information we collect under this Privacy Policy.

We are based in Ontario, Canada, and we handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable privacy laws. Where required, we ask for your consent, which may be express or implied depending on the sensitivity of the information and your reasonable expectations. You can withdraw consent at any time, as explained below.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal or regulatory reasons. We will post the revised policy on the Site, update the “Last updated” date above, and take any other steps required by applicable law.

What personal information we collect

“Personal information” means information about an identifiable individual. The information we collect depends on how you interact with us.

Information you give us

  • Contact details, such as your name, address, phone number and email address.
  • Order information, such as your billing and shipping addresses, payment confirmation, email address and phone number.
  • Account information, such as your username and password.
  • Shopping information, such as the items you view or add to your cart.
  • Customer support information, such as anything you choose to include when you contact us. Please don’t send us sensitive health information unless it’s needed to answer your question.

Some features of the Services require certain information. You can choose not to provide it, but you may not be able to use those features.

Information collected automatically

When you use the Site, we and our service providers automatically collect certain information about your interaction with the Services (“Usage Data”) using cookies, pixels and similar technologies (“Cookies”). Usage Data may include device and browser information, information about your network connection, your IP address, and how you use the Site, your account and our emails.

Information from third parties

We may receive information about you from service providers who collect it on our behalf, such as our e-commerce platform provider and our payment processors, which collect payment information (for example, credit or debit card details and billing address) to process your payment and fulfil your order. We handle information from third parties in accordance with this Privacy Policy, but we are not responsible for its accuracy or for third parties’ own policies and practices.

How we use your personal information

  • Providing products and services. To process payments, fulfil orders, arrange shipping, delivery and pickup, handle returns and exchanges, manage your account, send you notices about your orders and account, and let you post reviews.
  • Marketing and advertising. With your consent, to send you promotional emails or text messages, which you can unsubscribe from at any time using the link or instructions in any message, and to show you relevant ads on our Site and other websites (see “Advertising and your choices” below).
  • Security and fraud prevention. To detect, investigate and prevent fraudulent, illegal or malicious activity. If you have an account, please keep your login details safe and contact us right away if you think your account has been compromised.
  • Customer support and improvement. To respond to you, provide customer support and improve our Services.
  • Legal and compliance. To comply with our legal obligations, enforce our Terms of Service, and protect our rights and the rights of our customers and others.

Cookies

We use Cookies to run and improve the Site (for example, to remember your cart and preferences) and to understand how visitors use the Site. Most browsers accept Cookies by default, but you can set your browser to remove or reject them. Blocking Cookies may cause parts of the Site, such as the cart or checkout, to work incorrectly.

Where required by law, when you first visit the Site you can choose whether to allow analytics and advertising Cookies through our cookie banner, and you can change your choice at any time using the cookie settings link on the Site. Cookies that are strictly necessary for the Site to work, such as your cart, are always on.

Advertising and your choices

We work with advertising partners such as Google, which may use cookies, pixels and similar technologies on our Site to collect information about your browsing (for example, the pages you view and the products you add to your cart) so that they can show you relevant Truly Market ads on other websites and help us measure how well our ads work. These partners handle that information under their own privacy policies.

You can opt out of personalized advertising at any time:

  • Google: visit Google Ads Settings (My Ad Center) to turn off personalized ads, or install the Google Analytics opt-out browser add-on.
  • Interest-based ads from participating companies: visit the Digital Advertising Alliance of Canada’s YourAdChoices.ca.
  • Your browser: block or delete third-party cookies in your browser settings, or use your device’s settings to limit ad tracking.

Opting out means the ads you see will be less relevant, not that you’ll see no ads.

How we disclose personal information

We do not sell your personal information. We may disclose it:

  • To service providers who act on our behalf, such as our e-commerce platform provider, payment processors, shipping and delivery carriers, email and marketing tools, review providers, analytics providers, IT and cloud storage providers. They may use your information only to provide services to us, or as described in their own privacy notices where they act independently.
  • To advertising partners such as Google, through cookies and pixels on our Site, to show you relevant ads and measure ad performance, as described in “Advertising and your choices” above.
  • When you ask us to or otherwise consent, for example when you use social media features.
  • In connection with a business transaction such as the sale or reorganization of our business.
  • When required or permitted by law, for example to respond to a court order or lawful request, and to protect our rights, our customers or others.

Reviews and other public content

If you post a product review or other content in a public area of the Services, it will be visible to anyone. We are not responsible for how others use information you choose to make public.

Third-party websites and links

The Site may link to websites and platforms operated by third parties, including social networks. Their privacy and security practices are not ours, so please review their policies. Including a link does not mean we endorse that site.

Children

The Services are not intended for children, and we do not knowingly collect personal information from children. If you are a parent or guardian and believe your child has given us personal information, please contact us and we will delete it.

Storage outside Canada

Our service providers may store and process your personal information outside Canada, including in the United States. While it is outside Canada, your information is subject to the laws of that country and may be accessible to its courts, law enforcement and national security authorities.

Visitors in the European Economic Area and the United Kingdom

If you are in the EEA or the UK, we process your personal information to perform our contract with you (for example, to fulfil your order), to comply with legal obligations, for our legitimate interests in running and securing our business, and, for analytics and advertising Cookies and marketing messages, on the basis of your consent, which you can withdraw at any time. In addition to the rights above, you may have the right to object to or restrict certain processing and to receive a copy of your information in a portable format. Your information may be transferred to Canada, which the European Commission recognizes as providing adequate protection for commercial organizations, and to other countries using appropriate safeguards. You can also complain to the data protection authority where you live.

Security and retention

We use reasonable physical, administrative and technical safeguards to protect your personal information. However, no security measure is perfect, and information sent over the internet may not be secure in transit, so please don’t send sensitive information through unsecured channels such as regular email.

We keep personal information only as long as we need it for the purposes described in this policy, such as maintaining your account, providing the Services, meeting legal, tax and accounting requirements, and resolving disputes.

Your rights and choices

  • Access and correction. You can ask to see the personal information we hold about you, how we have used it and to whom we have disclosed it, and ask us to correct anything that is inaccurate.
  • Withdrawing consent. You can withdraw your consent to our use of your personal information, subject to legal or contractual restrictions. If you do, we may not be able to provide some Services.
  • Deletion. You can ask us to delete your personal information, subject to what we must keep by law.
  • Marketing. You can unsubscribe from promotional emails or texts at any time. We may still send you messages about your orders or account.
